1. Quotes & Scope of Work

All quotes are based on the scope of work, site conditions and information available to Cleaver Ceilings at the time of quoting.

The quoted price includes only the work and materials specifically described in the quote.

Any work outside the agreed scope may incur additional charges and will be discussed with the customer before proceeding wherever reasonably possible.

Quotes are valid for 30 days from the date issued unless otherwise stated.

2. Site Conditions

The customer is responsible for providing Cleaver Ceilings with reasonable access to the work area.

The quoted price may need to be reviewed if concealed or unforeseen conditions are discovered after work commences, including but not limited to:

● Structural defects

● Damaged or deteriorated framing

● Unexpected water damage

● Hidden electrical, plumbing or other services

● Asbestos or other hazardous materials

● Existing building defects

● Conditions that could not reasonably be identified during the initial inspection

Where additional work is required, Cleaver Ceilings will discuss the additional cost with the customer before proceeding where reasonably practicable.

3. Variations & Additional Work

Any changes to the agreed scope of work must be approved by the customer.

Where additional work or materials are required, Cleaver Ceilings will provide the customer with details of the additional work and associated cost before commencing the variation, where reasonably practicable.

For work covered by WA home-building legislation, variations will be documented in accordance with the applicable legal requirements.

4. Payment

Unless otherwise agreed in writing, payment is due upon completion of the agreed works.

Payment may be made by the payment method stated on the invoice.

The customer agrees to inspect the completed work upon practical completion and notify Cleaver Ceilings of any concerns as soon as reasonably possible.

Where a deposit or progress payment applies, it will be stated on the quote or contract and handled in accordance with applicable WA legislation.

For contracts covered by the WA Home Building Contracts Act, deposits and progress payments are subject to statutory requirements. (Western Australian Government)

5. Late Payment

Where an invoice remains unpaid after the agreed payment date, Cleaver Ceilings reserves the right to recover reasonable costs associated with the collection of outstanding amounts, where permitted by law.

6. Access & Delays

The customer must provide safe and reasonable access to the property and work area.

Cleaver Ceilings will make reasonable efforts to complete works within the estimated timeframe provided.

Completion dates may be affected by circumstances outside Cleaver Ceilings’ reasonable control, including:

● Weather

● Material availability

● Other trades

● Unexpected site conditions

● Delays caused by the customer

● Access issues

● Electrical or plumbing requirements

● Events outside our reasonable control

7. Electrical Work

Cleaver Ceilings does not carry out electrical work unless specifically stated otherwise and where legally permitted.

Where electrical disconnection or reconnection is required, the customer may be required to arrange a suitably licensed electrician, or Cleaver Ceilings may arrange this as part of the quoted works where specifically included.

8. Existing Damage & Defects

Cleaver Ceilings is not responsible for pre-existing defects, deterioration or damage that was present before work commenced.

Ceiling repairs can sometimes expose previously concealed damage or defects. Where this occurs, the customer will be advised and any additional work will be quoted or agreed before proceeding where reasonably practicable.

9. Painting

Unless specifically stated in the quote, painting is not included.

New plasterboard, flushed joints, repairs and sanded surfaces are generally supplied ready for the customer’s painter to prepare and paint.

Minor variations in surface appearance may become more noticeable after painting depending on lighting, paint finish and the condition of the existing structure.

10. Workmanship & Defects

Cleaver Ceilings aims to provide quality workmanship and complete all works to an appropriate professional standard.

If the customer believes there is a defect in the workmanship, they should notify Cleaver Ceilings in writing as soon as reasonably possible, including photographs where appropriate.

Cleaver Ceilings will assess the issue and, where the issue is found to be a defect covered by the applicable contract or legislation, arrange appropriate rectification.

Nothing in these terms limits or excludes any rights or guarantees the customer has under the Australian Consumer Law or applicable WA legislation.

For applicable WA home-building contracts, statutory defect obligations may apply. (Western Australian Government)

11. Materials

Materials will generally be selected based on suitability, availability and the requirements of the agreed works.

Where a particular brand, product or finish has been specified in the quote, Cleaver Ceilings will make reasonable efforts to supply that product.

If a specified product becomes unavailable, an alternative may be proposed for the customer’s approval.

12. Customer Responsibilities

The customer agrees to:

● Provide safe access to the property and work area.

● Remove or secure valuable, fragile or personal items from the work area.

● Inform Cleaver Ceilings of known hazards or relevant site conditions.

● Ensure pets and children are kept away from the work area.

● Provide access to required areas of the property.

● Obtain any approvals or permissions that are the customer’s responsibility.

13. Dust, Noise & Disruption

Ceiling repairs, replacements, sanding and plastering can create dust, noise and disruption.

Cleaver Ceilings will take reasonable steps to minimise dust and mess and will clean the work area upon completion of the quoted works.

Existing surfaces, furniture and belongings may still be exposed to some dust or disturbance.

14. Asbestos & Hazardous Materials

If asbestos or another hazardous material is suspected or identified, work may need to stop.

Additional testing, removal or remediation may be required and is not included unless specifically stated in the quote.

Any asbestos removal will only be carried out where appropriately licensed and in accordance with applicable requirements.

15. Waste & Disposal

Waste disposal is included only where specifically stated in the quote.

Where disposal is included, Cleaver Ceilings will remove and dispose of construction waste generated by the agreed works.

Additional waste or materials not included in the original scope may incur an additional disposal charge.

16. Photos & Completed Work

Cleaver Ceilings may request permission to photograph completed works for use on its website, social media or marketing material.

No identifying personal information will be intentionally included without the customer’s permission.

17. Cancellation & Rescheduling

If a customer needs to cancel or reschedule a booked job, reasonable notice should be provided.

Cleaver Ceilings reserves the right to recover reasonable costs already incurred in relation to materials, subcontractors or other expenses specifically arranged for the customer’s project, where permitted by law.

18. Customer Satisfaction

Cleaver Ceilings aims to complete every job to a high standard and ensure the customer is satisfied with the completed works.

Any concerns should be raised with Cleaver Ceilings as soon as possible so they can be assessed and, where appropriate, resolved.

19. Australian Consumer Law

Nothing in these Terms & Conditions is intended to exclude, restrict or modify any consumer guarantee, right or remedy that cannot legally be excluded under the Australian Consumer Law or other applicable legislation.

20. Acceptance

Acceptance of the quote, contract or commencement of the agreed works constitutes acceptance of these Terms & Conditions, subject to any specific terms stated in the individual quote or contract.

Where legislation requires a formal written contract signed by both parties, the formal contract will apply.
